"Ken and Barbie vs. Goliath IRS": Ken Cromar presently sits in prison having been found guilty of living in his own fully owned home and after proving in a Federal Tax Court that he owed no monies to the IRS. Despite the ruling in Cromar's favor, the IRS sold his home at auction and threw away all his possessions including expensive camera equipment he used to make a living. He was arrested almost a year ago and has been sitting in prison since.

For 3+ years Barbara & I have been blocked from access to the Utah Fourth Court and defending ourselves.  This has been a gross miscarriage of justice and fraud upon the court.

GOOD NEWS:  We finally got a hearing yesterday on our seeking of the right to APPEAL to the Utah Court of Appeals.

As you may recall, Barbara & I were convicted of Burglary of our own home on July 1, 2022!  It was a kangaroo court trial, which now we can prove was a fraud committed on the court by the Utah County Deputy Attorney Jared Perkins and others.  We didn't get justice during the trial, so, as is our right, we've been trying to Appeal since January 4, 2024 last year.  Yesterday, we had our day in court.

THE PROBLEM:  For 3+ years* (see below), all of our filings were blocked by the court because the Utah County Prosecutor convinced the Utah Fourth District Court Judge Christine Johnson to label us as "vexatious litigants", and blocked us from filing documents in our own defense.  We couldn't effectively defend ourselves.  So, no surprise, we were convicted July 1, 2022.  Justice was denied.  Our efforts to Appeal were blocked too.

During this time, the judge denied us our constitutional right to counsel of our choice requiring us to have a "state licensed BAR attorney". ** (see below)  Also, the "Public Defender" Lisa Maxine Estrada forced onto us by the judge, never returning any phone calls, nor responding to any emails, and returning ALL my mail to her unopened.  How can the court claim I had "due process of law" and justice when we were blocked from defending ourselves by the court?  Nonsense!

After 3+ years of legal limbo, at our insistence, Estrada finally quit, and pushed us to the Appeal section of the Public Defender Office (PDO).  That office agreed with us that we hadn't been able to get the help we needed from them. And while we never wanted to have an attorney, but with the court making Justice IMPOSSIBLE, I reluctantly accepted the PDO offer to pay for "conflict counsel", which means they would pay for an outside firm to represent me in the Utah Court.  This allowed us to reluctantly use these attorneys to ask for the permission needed to file an appeal to the Utah Court of Appeals at the next level.  The goal, to win the Appeal and have the fraudulent case thrown out, or at worst a new trial.

SOLUTION:  Yesterday, Judge Johnson held a Hearing.  My attorneys are Emily Adams, a partner at The Appellate Group -- 15 women attorneys who all have clerked for Appeal court judges -- and win a high percentage of their cases, and Rachel Anscough, explained my position beautifully, and left the Prosecutor stumbling and bumbling, and defaming us before the judge.  (When it was over the Prison official listening in the room said, "What a dick!", then asked, "Who is she?"  "She's one of my attorneys."  He replied, "She did a good job.  She has teeth!)

The Prosecutor struggled to try to convince the judge that, "The Cromars are simply continuing to try to abuse and burden the court, by wasting their time and money.  They must be stopped."  Emily responded with something like, "The only person who is being burdened is the one who currently sits in prison waiting for justice -- Mr. Cromar."  Wow!

Emily also highlighted that it would be a serious breech of constitutional rights, that the Utah Supreme Court has already ruled on in situations similar to this case with Mr. Cromar.  And, Emily's final comment was, "In ALL cases where there is a Public Defender office involved in a case similar to this situation, the Public Defender MUST file an appeal for the Defendant whether the pro se defendant does it himself, or not."  Boom!  Wow!  (BTW, we had filed an appeal, but the court blocked it.  Therefore, Emily pointed out, the responsibility was on the Public Defender office to make sure it happened.  It didn't.

RESULT:  At the end of the 60 minute hearing, Judge Johnson said she would be providing her written decision, and the hearing suddenly ended.  The Prison did not have video, and so I could only listen, but from what I could hear I thought Emily knocked it out of the park, and wrote her an email thanking her.  Raland, who watched it, said he thought Judge Johnson was carefully and thoughtfully listening to Emily's great points.
